Hi Legal Helpmate,

I'm currently planning to get married to my fiance and we've talk about making an Prenuptial Agreement.

My question to you is would this Prenup work even thought I'm overseas in Germany and my fiance is a local national ”German”...

will this still be recognize by US and German Law.

Thank you for asking an interesting question,

We agree with you that it will be a really smart move to sign a prenuptial agreement especially if you and your fiancé belong to different nationalities.

Please be advised that Legal Helpmate is the USA based company, therefore we can not discuss Germany law. However, as far as we know, Germany welcomes and honors Prenuptials. So, the answer to your question is yes, both countries will honor your premarital agreement.

We understand from you email that you are an American citizen living abroad. So, you may use our Prenuptial Agreement form to enter into an agreement in Germany.

One of the significant clauses in your contract would be the choice of governing law.
You must choose whether you want the USA law (and what state law), or Germany law to administer your prenuptial.

Please note that most states in the USA require complete disclosure of the assets belonging to both parties to the contract.

Hi

My question somehow related to Robert case. I am a US citizen and my girlfriend is a German, she live with me now. and we plan to get married, we both married before and have children from previous marriage. should we hire attorneys for this?, having in mind that she is not very well understand English language and if she has to have attorney, I have to find one for her. I think that's may be conflict of interest for me doing it. Is using these online pre-made forms will be ok?

Dear Alan,

As we understand from your post, your fiancé is already in the United States and you are planning to live in the USA after marriage. Therefore, you may use our Prenuptial agreement form to enter into the agreement.

Given the fact that your fiancé is not fluent in English we strongly recommend her to talk to matrimonial attorney (preferably German speaking), and ask him to go over the contract with her. You may save a bunch of money if you bring an existing prenuptial contract to an attorney and just ask him to clarify several moments, instead of asking an attorney to draft a new contract for you.
