A relative initially had an Revocable Trust drawn up by the first lawyer but it did not include her home. Let's call it "Mary Revocable Trust".

Then she had a second lawyer register her home in a document that reference the "Mary Family Realty Trust" that was submitted to the Registry of Deeds.

My question is: Would there be a legal issue since the two Trust names are not the same. And if so, how could it be solved. My guess is that the original Trust should mention the 2nd Trust in an amendment. Anyone have suggestions?

Dear Caesar,

Based on the circumstances you mentioned, we presume that there are two different trusts now, and they will be treated as such.
The only way to straighten things out is to revoke one of the trusts and make amendments to the second trust.
