Dear Helpmate, I would like to know if a prenuptial agreement protects an inheritance not yet given, ie, the willing partie of the will is still living. Thanks for any help.

We understand your concerns regarding your future inheritance in the light of your marriage.
Generally speaking, all your assets acquired during your marriage, may be divided into marital assets and separate assets. Marital property is all property acquired during the marriage by either spouse. However, the law of each and every state exempts some of the assets from marital property if, among others, it was received as a gift, devise, or descent.
Therefore, you may definitely address the future inheritance in your Prenuptial Agreement, to be on the safe side; but it will be treated as your separate property anyway.
