I jus finished filling out a military general poa for my husband, and the first big paragraph says "Federal Law exempts a military power of attorney from any requirement of form, substance, formality or recording that is prescribed for Powers of Attorney by the laws of any state, commonwealth, territory, district, or possession of the United States. Federal law specifies that a military power of attorney shall be given the same legal effect as a power of attorney prepared and executed in accordance with the laws of the jurisdiction where presented." And later it also states that "no seal is required on this certificate" if signed by a noncommissioned officer.

Does that mean I don't have to get it notarized by an NP???

Dear Sarah,

As you correctly mentioned in you question, the requirements for issuance of a
Military Power of Attorney differ from regular Power of Attorney. While it is true that Military POA does not require Notary Public Acknowledgment, people that deal with this document are often get confused because of absence of Notary stamp. Therefore, it will not harm to have it notarized as a regular power of attorney, to make your life easier afterwards.
