What is the shortest time to get a divorce in NYS. For any of the reasons. Should I move to get a divorse sooner.

Whether you can file for a divorce in NY depends on many circumstances.

According to NY Domestic Relations Law a person may file for a divorce in NY on the following grounds:

Cruel and inhuman treatment; abandonment for 1 year; adultery; 3 years of imprisonment of one of the spouses; conversion of separation agreement into a divorce decree.

We understand from you email that currently you are not a resident of NY. Please note that generally one of the spouses may file for a divorce in NY after he/she satisfied 2 years residence requirement for NY.

However, if NY was your “matrimonial domicile”, meaning that your marriage procedure was performed in NY or the family resided in NY for some time; or the ground for divorce arose in NY, a spouse must have resided in NY for one year instead of two years before he may commence a divorce proceeding. Anyway, if you want a so called “quick divorce” NY is not the place you should look for.

I have afriend of mine that got married in the Cayman Islands and he wants to get a divorce but the wife does not want one how can he go about that. Because he is coming to live in New York so he wants to know if it can be done in New York?

We think that your friend will not succeed in filing for divorce in NY at the present moment. As we understand your friend’s circumstances, neither he nor his spouse lived in NY before the marriage; and the marriage ceremony was performed outside of NY.

Before filing for divorce in NY, a person must satisfy residency requirements, set forth in Domestic Relations Law §230.

Among these requirements are:


  • NY residency;

  • marriage ceremony in NY and continuous living in NY before the ceremony;

  • living in NY after the marriage;

  • the grounds for divorce occurred in NY and either party is a resident of the state.

You wrote in your post that your friend is panning to move to NY sometime soon. Thus, he has a choice: either live in the state for two years and then bring an action for divorce, or file it in Cayman Islands.
