We understand that you, as many married couples, want to enter into a postnuptial agreement to help resolve potential issues in your marriage by removing a source of disagreement over finances, assets, children, chores, etc.
We can say that it is a fast growing trend to enter into postnuptial agreements nowadays. Traditionally, common law did not recognize “post nuptial agreements”, but we would recommend you to talk to an attorney experienced in matrimonial matters in your state to find out whether the case law recognizes post-nuptial agreements. If yes, then go ahead and sign it.
Please note that if postnuptial contract is challenged in court it may be scrutinized even more carefully than prenuptials.
