My husband & I have a joint living trust. We have no children. The trust is now set up to include sibling beneficiaries from both of us, (in case we should die at the same time). If one of us should die prior to the other, can the surviving spouse amend the trust to remove the deceased spouse's siblings as beneficiaries?

Dear Judy,

The answer to your question is "No" because even if you and your spouse set up a "revocable" living trust, as soon as one of the spouses dies the trust becomes irrevocable.

You may not change the terms of an irrevocable trust.
