Requirements for District of Columbia divorce

Residency Requirements:
Before filing for a divorce in the District of Columbia, one of the spouses
must have been a resident there for at least six months prior to filing.
Military personnel are eligible to file if they have been stationed in the
District of Columbia for six months.
Legal Separation:
Legal separation (from bed and board) will be awarded if based on:
1) adultery;
2) cruel and human treatment;
3) living separately and apart without cohabitation.
General Divorce Procedure:
There are no legal provisions in the District of Columbia regarding a simplified divorce.

Grounds for District of Columbia Divorce:
The only grounds for divorce in District of
Columbia are mutual voluntary separation without co-habitation for six
months, and living separately and apart without co-habitation
for one year.
Mediation or Counseling:
The court may order either or both spouses to attend parenting classes
in those cases in which child custody is an issue.
Where to file for divorce:
File for divorce in Superior Court; Family Division.
Title of Divorce action:
Complaint for Divorce.

Rights to Maiden Name:
The former or maiden name will be restored upon request.
Go to "Change Name" service
Filing Fees:
Court filing fees are in addition. Please check with your local
courthouse to determine the exact amount.
