Making a Premarital Agreement Valid.


A Premarital agreement must be in writing to be legally binding. A written agreement provides evidence of the terms of the agreement and helps show that both people understood and agreed to the stated terms.
 
In general, a written Premarital agreement is legally binding as long as it is reasonable, fair, and entered into voluntarily and without fraud. A Premarital agreement is not binding if a person is unfairly induced to enter into the agreement or did so under excessive emotional pressure. Also, a court may refuse to enforce sections of a Premarital agreement if those sections violate public policy.
 
Often, one party may have a more sophisticated understanding of financial matters or of the law than the other. It is a good idea to involve a Lawyer in preparing or at least reviewing your Premarital agreement before finalizing it. This will help ensure that the agreement does not later appear unfair or one-sided to the courts.
 
A Premarital agreement may be formed any time before Marriage, but it is best to do it well in advance of the Wedding. This avoids the appearance of undue pressure and helps ensure that both sides have thought carefully before signing.
