How does a judge divide physical Property?


Unlike cash or stock, which the judge can simply divide in half, you can't give someone half a car or house in a divorce case. Judges have discretion as to how to handle this problem. The judge might get estimates of value and award one spouse the car and the other spouse some jewelry to equalize the division. Or the judge might order the Property sold and the proceeds divided. Because of this, it is a good idea to come to some agreement with your spouse, so that you aren't required to sell Property you would like to keep or to wait for a long period of time before you receive anything. A good Lawyer will be able to tell you what you are likely to get if you let the judge decide, so you and your spouse can make your own decision as to how the Property should be divided to satisfy both parties as much as possible.
