Family Law - Separation and Divorce.


When a husband and wife decide they can no longer live together, they may decide to separate for a time before divorcing. A husband and wife are legally separated when they are living apart and have formalized their arrangement by a court order. This order often explains how spousal support and child support, custody, and visitation issues will be handled. Its terms can be modified by the parties or by the court. Someone who is legally separated cannot remarry until his or her divorce has been finalized. Separation can formalize arrangements for couples that are merely waiting for their divorce to be final. Or it can give couples time to decide if they are sure they want to go through with divorce. Other couples may, for religious or other reasons, remain separated permanently, never divorcing. In most states, a couple does not have to be legally separated in order to get a divorce.
 
A divorce is a court order that a Marriage no longer exists. It frees both parties to remarry and usually dictates issues of spousal support; child support, custody, and visitation; and Property division. Most divorces (over 95%) are settled out of court with the help of attorneys and mediators.
