A Power of Attorney should never be made indefinite or permanent. The best course is to set a date for the Power of Attorney to expire as soon as possible after the intended action has taken place. Powers of attorney should normally be granted for a one year maximum. You can always renew your Power of Attorney if necessary. Additionally, a Power of Attorney expires when either you or your agent dies or when revoked by you. (This would be a Non-durable Powers of Attorney">Nondurable Power of Attorney). However, under Tennessee law, your attorney-in-fact may continue acting under your POA until receiving actual notice of your death or incapacity.
