Washington State Trial Court Gives Equitable Relief to Lesbian Couple.
In a case homosexual advocates have mischaracterized as a “same-sex Legal divorce,” a Washington state trial court last week awarded a lesbian woman an equitable share of Property owned by her ex-partner’s at the termination of their 10-year relationship. When their relationship soured, Linda Gormley sued her partner, Dr. Julia Robertson, for a share of Robertson’s home and jointly-held assets. In last week's ruling, the trial court held that their relationship was “sufficiently Marriage-like to provide equitable relief,” and called it an “intimate domestic partnership.”
While Gormley was found entitled to a share of their house, furniture and cars, as well as liable for their joint debts, the court did not grant a "divorce," or otherwise suggest that the two women were "married." Instead, the judge ordered a fair division of the Property the two accumulated while living together, so as to avoid a result where one party takes advantage of the other. The decision follows precedent from earlier cases involving long-term heterosexual cohabitatants, as well as a ruling handed down by the Washington Supreme Court earlier this year in which the court held that a man may have an equitable claim to part of his deceased homosexual partner's estate.
