The Declaration of Living Trust as well as most of the other living trust documents and forms must be signed before a
notary public or other public officers authorized to administer oaths.
There is however, an exception to this requirement, and that is:
- If the Declaration of the Living Trust is established in the State of Florida, then it must be signed in the presence of two witnesses rather than before a notary public.
- Also, the State of Florida requires proof of identity when signing before a notary public, and therefore, such proof must be indicated in the notary acknowledgement.
