There are many types of Power of Attorney.


With a Power of Attorney, an individual (known as the Principal) authorizes another person to act on behalf of the principle as an Agent (known as the attorney-in-fact). The Power of Attorney will authorize the person you have appointed to perform all Legal acts that you could have done yourself. Generally, an individual may grant powers of attorney so long as the individual is not under any Legal disability.
 
There are many types of Power of Attorney. You may have a General Power of Attorney, a Limited Power of Attorney, a Durable Power of Attorney, a Financial Power of Attorney, a Health Care Power of Attorney, or a child Care Power of Attorney to mention just a few.
 
The most common type is a Durable Power of Attorney that is for financial purposes. It is drafted to be used in almost every financial situation. In some states, there must be specific reference to authority in real estate transactions. A general grant of authority regarding real estate transactions is not sufficient. Generally a Power of Attorney does not need to be recorded; however, if it is being used in real estate transactions, it must be recorded with the Register of Deeds Office or in the County Clerk's Office. Each State has different requirements as to which Office the Power of Attorney must be recorded. The Power of Attorney will remain effective until it is revoked by the Principal which should be in writing.
