Illinois - Will a Durable Power of Attorney for Health Care be recognized in another state?

The best time for you to create a Power of Attorney for Health Care is before you anticipate anything happening to you. Acting now insures that your agent is in place and ready to act if the need arises.

Most state statutes recognize either a general or a specific Power of Attorney for Health Care. However, a problem may arise concerning whether or not the document must be witnessed and/or notarized. Since the state statutes vary, it may be a good idea to have your Power of Attorney both witnessed and notarized. Additionally, it may be a good idea to execute a Power of Attorney pursuant to the laws of both the state where you reside and any state where you routinely receive health care or where you often visit. An attorney's advice may assist in coordinating multiple Powers of Attorney.
